簡單地說，
要證明侵權，需要透過ITC的程序要求檢視雙方的source code(attorney's eyes only)，
然後看在被告的source code中，哪些部份是踩到專利，
可是蘋果只有給了一張圖，
蘋果認為因為Gmail跟之前侵權的Browser有相似的畫面出現，
所以蘋果認為Gmail侵權，
殊不知Gmail跟Browser是兩個獨立的application，
如果可以這樣就判HTC禁售，
那麼蘋果會很高興，
因為它只要也在三星的手機中找到類似的圖，
它就可以說三星的手機應該禁售
